09.02.03 [Mydaily] Rain's agency, to take "strong measures on portrait rights" regarding calendar sales.
Rain's agent J-Tune Entertainment (a.k.a J-Tune) expressed its measures towards the right of portrait issues of its celebrities.
Last
2nd, J-Tune revealed their 'Guide towards portrait of agent
celebrities' in Rain's official home page. J-Tune wrote that "due to
usage of celebrity's portrait without permission caused by the
development of photography and recording, we are announcing the 'guide
towards portrait'" and warned that "usage of celebrity's picture, image,
name, voice, motion without permission from J-Tune can lead to legal
issues regarding right of portrait, right of publicity, copyright,
privacy right and invasion of right of honor."
In particular, J-Tune said that "the celebrity's portrait might have direct relation towards his/her image, so if any 'portraits' are abused, we will take firm measures." Also, J-Tune added that "even if non-profit is the purpose, when selling products related to the celebrities, please attain our permission beforehand" and emphasized that "usage of the celebrity's portrait without permission will call for strict measures."

reason for J-Tune's such stance is that they found out about certain
Rain's fans using Rain's pictures to sell calendars without permission.
Rain's official fan club Cloud revealed such happening by posting 'apologies to fans about the calendar issue'. Cloud said that "although Rain calendar was at its last stages and the sample was out, the project has been postponed due to unforseen issues" and added that "we found out about cooperative purchase of (DIY) calendars and asked for them to stop and believed their word that they have done so, but found out only a few days back that the cooperative purchase has been done and the goods have been sent already".
Cloud continued that "not only us but J-Tune also got involved in this issue and was left with no other choice but to postpone our calendars also due to portrait right issues." and expressed their apologies for "postponing indefinitely a bazaar that was being planned where Rain could join in with the fans."

Hello, this is J.Tune Entertainment.
Due to the development of technology of photography, record, and etc. these days, lots of legal issues occur from
the disapproved use of artists. Accordingly, J.Tune Entertainment (hereinafter “Company”) announce its policy of
its artists (hereinafter “Artists”)’ portrait right.
1. Policy of portrait
(1) Pursuant to Company’s contract with Artists, Company is authorized to protect Artists’ portrait rights and
other relevant rights.
(2) Please keep in mind that in the event to film, disclose, copy, transmit, exhibit, screen, distribute, lend, or
produce the secondary works of the picture, artwork, character, footage, or others (hereinafter “Pictures”)
of Artists’ portrait, image, name, voice, motion, and/or something to show Artists’ identity (hereinafter “Portrait”), without Company’s prior consent, the civil and/or criminal responsibility can be asked to the person who
conducts the acts, due to the infringement of portrait right, publicity right, copyright, privacy right, and/or fame right.
(3) Prohibited activities
Without limitation, the followings are prohibited;
- Disapproved use of Artists’ Portrait into advertisement and/or publicity
- Manufacturing or selling goods by disapproved use of Artists’ Portrait
- Any and all disapproved use beyond personal use of Artists’ Portrait
- Malicious transformation, distortion, damage of Artists’ Portrait
- Writing groundless rumor and/or scandal of Artists
- Filming and disclosing Artists’ pictures, footages, and etc. which Artists don’t want to disclose and/
or public can feel unpleasant.
- Especially, in the place in which filming is not allowed, please restrain from filming Artists’ pictures,
footages, and etc. in order to protect Artists’ privacy right and personal right.
- Also, please keep in mind that filming in concerts and award ceremonies is not allowed.
(4) Even though it’s not for profits and commercial purpose, in any and all kind of cases to
manufacture and/or sell products related to Artists, please get Company’s prior permission.
Company will take strong actions to the disapproved activities to use Artists’ Portrait.
2. Report of portrait right
In the event that the cases for Artists’ Portrait to be used without Company’s consent are found,
please let Company know so that it can take a proper action immediately.
