10TH CHAPTER
THE PROOF OF OUR THIRD CLAIM
411
So how did this whole thing became a scandal?
412
All theat needed was just some:
- frustrated public sentiment due to the compulsory military service,
413
- anger, generated by the political forces,
414
- sensationalist media,
415
- sensation-hungry audieance, which trusts the media without hesitating,
416
- some anonymously emitted
envy, jealousy, malice, repressed aggression and tendency to take the law into their own hands...
417
« MINEFIELD »
418
THE INTERPLAY OF THE POLITICS, THE MEDIA AND THE NETIZENS
419
THE ROLE OF THE POLITICS
420
Due to the tragic incidents between North and South Korea in 2010, the desires for a shortened mandatory military service came to nothing and the establishment of a professional army became a distant aim.
421
In this de jure war situation, which places great burdens on everyone, the society shows zero tolerance for those people, who want to avoid the mandatory military service or at least try to get easily away with it.
422
In the fights of the political parties the exploitation of this topic is obvious for them to gain political ground, because there is no Korean person or family who is not affected by this issue.
423
The opposing, the Democratic United Party (DUP) found the theme of the celebrity soldiers and tried to make political capital of the proof of the favoritism on them, so they attacked the DEMA.
424
The lawyers of the party wrote an essay and prepared statement about the excessive vacationas of the celebrity soldiers which the MPs of the party kept on the agenda of the National Assembly and its committees repeatedly for years.
425
They already shocked the public with astonishing numbers in 2011.
426
« SOOMPI, 09/20/2011 »
427
428
The general and presidential elections took place in 2012 in South Korea.
The DUP didn't give up and in October, in the finish of the presidential election campaign they warmed the topic up placing the famous Rain in the focus of their attacks, who served at the DEMA.
429-431
« NATE NEWS, 10/19/2012 »
432
« MTV KOREA, 10/22/2012/ »
433
434
The 'divide and conquer' strategy which was used by the DUP is familiar from a while back:
match the 'ordinary' soldiers against the 'celebrity' soldiers then step forward in the mask of justice - the political success is guaranteed.
435
The attacks of the DUP which was constantly in opposition, are not primarily focused on celebrities but on the DEMA and the Ministry of Defense and through them ultimately to the real political opponent: the governing Saenuri Party.
436
« LET'S SEE CLEARLY »
But what does this have to do with Rain or any celebrity-soldier, who served in the unit?
437
Nothing at all.
They only toy soldiers in a power game in which the result of their civilian lives and the achievement they earned with hard struggles are jeopardized.
438
« THE METHODOLOGY OF THE STATEMENTS »
What kind of method did the legal experts of the DUP work with?
439
« CORRECT STATEMENT »
According to the statement of the DUP until the mid-September 2012, Rain received 13 days regular vacation and 5 days special vacation.
Their marks in our calendar are:
[mark] on the red background.
Comparing our calendar the statement of the regular leave is almost correct. They didn't find a 4-day leave because of its wrong date.
440
441
« DISTORTED STATEMENT »
According to the statement of the DUP, until end of September 2012 Rain received 10 days regular leave.
Their marks in our calendar are:
[mark] on the dark blue background.
These days were available on the bases of a scoring system. The statement included all 10 days, although Rain used only 1 day in that period. Comparing our calendar the statement of the regular leave is distortion.
442
443
« FALSE STATEMENT »
According to the statement of the DUP until the mid-September 2012, Rain received 34 days mon-official leaves.
Their marks in our calendar:
[mark] on the medium blue backround.
Comparing our calendar these days were official leaves and do not belong to the vacation days!
The statement is false.
444
445
The result of the addition of the correct + distorted + false numbers by the legal experts of the DUP:
Rain received 62 vacation days until 09/15/2012.
By contrast the correct number is: 23.
446
« A SAD FACT »
So the legal experts of the DUP pretended as if they could not distinguish between the regular vacation and the task assignment furlough, furthermore between the used and unused vacation days.
447
« CONCLUSION »
But if they really could not make a difference, then they are not experts.
However, if they intentionally distorted the facts, then it is the deliberate deception of the public opinion.
448
« EXPLANATION »
Because they need to know as a legal experts that
- the possibility of the night sleep must be ensured for the soldiers
- a task assignment furlough is not the personal leave of the soldier.
449
« WE DO NOT UNDERSTAND SOME THINGS EITHER, HOWEVER THESE ARE NOT THE SAME »
For the greater dramatic effect, in the press the DUP even notes:
450
451
« WE DO NOT UNDERSTAND SOME THINGS EITHER, HOWEVER THESE ARE NOT THE SAME »
We believe that if they really did not understand, then they should have asked the DEMA to ensure the accurancy of their "study".
452
But which media outlet is the source of this incomprehension?
453
454
By chance the Sports Seoul.
Rain brought a $ 300.000 libel action against the journalists of the newspaper in 2010.
455
THE TABLOID IN THE SERVICE OF THE POLITICS
456
« TIMED TABLOID BOMB »
457
In the election period these mines have not yet exploded. Something more was needed and it was provided by the tabloids on the 1st of January, 2013.
458
The minefield was hit by the articles of the Dispatch about the relationship of Rain and actress Kim Tae-hee.

524
« MALFUNCTION IN THE DREAM FACTORY »
The Korean tabloid using a weird phrase 'scandal' serves the disclosure of the famous people's romantic relationships. Many of the audiences react with jealous rage due to the loss of their 'dream partner' and express their disappointment with furious outburst.
In this case parts of the huge fan bases of two leading celebrities produced similar symptoms.
525
Extremists even questioned whether a soldier has the right to a partnership at all.
526
« HIDDEN AIM »
Did the articles of the Dispatch really speak about a new relationship?
527
Apparently, yes.
However, the real intention of the Dispatch:
to contribute to the truth of the privileges of the celebrity soldiers with some new additionals.
528
Therefore the tabloid tried to prove with awkward effort that Rain received a lot of extra leave and he almost always dated.
529
What kind of tools did the Dispatch work with and what did they find?
530
« ACCORDING TO THE DISPATCH »
They have "collected the matter" for 2 months and then followed Rain and Kim Tae-hee for 2 months, thus from September to December.
531
532
533
« WELL, ALSO WAS THE DISPATCH AMONG THEM? »
The Dispatch said that the couple "dated actively from September 2012".
As a reminder: Rain was hospitalized from the 23rd of September because of his spinal hernia. We sincerely hope that his loved ones visited him.
534
« THESE ARE REAL VIOLATIONS »
Now, we do not deal with it whether the Dispatch how and how many times violated the personal rights of both celebrities during the "matter collection":
- sticking their nose into the celebrities privacy (including Christmas holidays !!!) and their private homes,
- "they often called each other" - How could they know this?, etc.
535
ABOUT THE EVIDENCES
536
How many photos were published in the Dispatch altogether?
537
« WE COUNTED THEM »
The number of the photos are only: 23
538
539
From the 23 photographs
- in 4 only to see cars,
- 18 photo (5+6+7) are phase images of only three different photo series.
Dates our not shown on any of the photographs.
540
Not a single piture show both parties together.
Kim Tae-hee actually unrecognizable in the photos.
On the several dates indicated by the Dispatch only the cars could be identified but their licence plates are obscured and it is not our job to do so anyways. People cannot be seen on the pictures.
541
« REASON »
Why we accept the images and the Dispatch's claims as evidences?
542
Because neither the media, nor the netizens, and not even the Ministry of Defense questioned the authenticity of them.
543
THE ISSUE OF THE REGULARITY OF THE DATES
544
« THE CHANCES OF THE DISPATCH »
In the last three months of the year, were 13 weekends in total. From these
- 6 times on Saturdays and Sundays,
- 6 times only on Saturdays
the radio show 'The Desire To Speed' were live broadcasts, so Rain was at the studio on those days.
Only on one of the weekend were not Rain and KCM the hosts.
545
So the paparazzi had at least 12 weekends to document the 'regular' meetings.
546
The report about the 23rd of November which was a Friday, and Christmas days reveals that the Dispatch followed both of celebrities on weekdays too. So they had the total 92 days 'to catch' them.
547
They lurked at Christmas too, when it was known that Rain was on regular holiday, therefore those days were inefficient to proof of the regularity of the meetings.
548
« PICTURES OF CHRISTMAS, ON 12/23-24/2012 »
549
« PICTURES OF CHRISTMAS, ON 12/23-24/2012 »
550
« PICTURES OF CHRISTMAS, ON 12/23-24/2012 »
551
« FAILS »
After all the officious tabloid-detectives were able to report only 3 meetings.
The dates were:
- 11/23/2012 (Friday)
- 12/02/2012 (Sunday)
- 12/09/2012 (Sunday)
552
« BAD LUCK »
Among these the 23rd of November was a Friday, so the number of the regular Sunday meeting decreased to 2.
553
Thus, the facts provided by Dispatch were:
during 92 days
1 weekday and 2 Sundays.
CAN THIS FREQUENCY BE CALLED REGULARITY?
554
NO, it can't.
This is neither regular, nor frequent.
THE ACCUSATION REGARDING THE REGULARITY OF THE MEETINGS DURING THE MILITARY SERVICE HAS NO PROOF.
555
« A LOGICAL QUESTION »
Is it possible that the Dispatch had materials on other dates but they decided not to published them along side with their weak documentations?
556
In our view NO.
557
Therefore we believe that they presented all their "evidence" to the public. So, according to the Dispatch, in those period which was monitored closely by them, Rain and Kim Tae-hee only met on three occasions that circumstances are still waiting clarification.
558
« THE METHODOLOFY OF THE TABLOID »
How did the journalists of the Dispatch offset this 'deficiency'?
559
They replaced the lack of facts with repetition of exaggerated, misleading and incriminating allegations:
"Barriers are not towering before them either time nor space in their profession."
"At all time when their time allowed they were on a date..."
"For having they were able to date such regularly..."
"In return for the regular dates..."
560
« THE QUIRK OF THE FATE »
But even so, the tabloid itself provided the most help to clarifying the situation.
561
THE REASONS OF RAIN'S LEAVES ACCORDING TO THE DISPATCH
562
Why was not Rain in the barracks?
563
11/23
"At this time Rain was on reward vacation after his performance at the 'Consolatory Train' concert in Gangwon."

566
567
« VERIFICATION QUESTION »
Does the entries in our calendar confirm these allegations?
568
569
YES, they do.
On the 22nd of December Rain really held a performance in Gangwon and he had no officially published program for the next day.
570
12/02 and 12/09
"As we entered into December, they were on date mainly Sundays. Since Rain was on vacation after his Saturday's live radio show. They were on date on 2nd and 9th of December."

574

575
576

12/02 and 12/09
"Rain was on leave on those days and he went out to the army."
577
578
« VERIFICATION QUESTION »
Does the entries of our calendar confirm these allegations?
579
580
YES, it does.
It can be seen, that other official tasks are not marked on those days and according to the DEMA, the two radio shows on Sundays were pre-recorded broadcasts.
581
« CONCLUSIVE STATEMENTS »
Thus, the Dispatch itself reported on the basis of its own information and experiences that Rain was on vacation/leave the previous day evening through the current day evening on all three occasions on 11/23, 12/02 and 12/09.
582
« STRANGE MISINTERPRETATION »
But, in the wake of the articles the media and the netizens accused Rain with something else.
583
It was that he inserted those dates into his OFFICIAL TASK ASSIGNMENT LEAVES.
584
« ESSENTIAL ELEMENT »
At the same time, did the Dispatch say or refer to it in any way, that Rain was on official, task assignment furlough at any occasions?
585
NO, they consistently wrote about regular vacation!leave.
THE MEDIA AND THE PUBLIC "IMAGINED" THE OFFICIAL TASKS INTO THE DESCRIBED TEXTS.
586
« DELUSION »
Because what grabbed the attention of the elated media and audience from the sensationalist texts of the Dispatch?
587
Perhaps ambiguous wording of the Dispatch:
"They met using up time for leave."
"In December they tried to meet using up time for leave."
588
« TEXT INTERPRETATION »
But time can be used up from a regular vacation/leave in order to fit in a date, right?
589
At this point can be detected that the political undermining work, which the media served continuously, finally reached its destination: the public suspected only illegal practices in connection to the PR-soldiers,
EVEN THOUGH THE FACTS WERE OBVIOUSLY SHOWING THE OPPOSITE.
590
« CIRCUMSTANTIAL EVIDENCES »
What other evidences can be found in the articles of the Dispatch that Rain was on regular vacation on these days and not on official, task assignment furlough?
591
11/23
"Rain came with his blue Mini Cooper, Kim Tae-hee with a white Toyota Camry."
592
593
11/23
"Kim Tae-hee came with her own Toyota Camry, Rain came with his family BMW Mini Cooper."
594
595
Why is this an evidence?
596
Because Rain could only obtain his own car if he visited his home first and he would also had to go home before he would return to the barracks.
This relatively long program (including the meeting) can not be done secretly during an official leave. In addition it would be exaggerated to assume that Rain traveled calmly in the city during his official leave.
597
« ONE MORE INDIRECT EVIDENCE »
598
No soldier can hold a private, civil wardrobe in the barracks.
599
« Pictures about Rain's military accomodation, published on 10/13/2012 »
600
« Pictures about Rain's military accomodation, published on 10/13/2012 »
601
So Rain's overcoat also proves that he was on regular leave, because he was able to get his coat obviously from home, which he would have to visit on that day.
This againd does not fit into a tight duration of an official leave.
602
« ADDITIONAL INFORMATION »
But why would Rain wear a winter coat if it would not quite fit the regulations?
603
Because 12/09 was the coldest day of the year of 2012, with the lowest temperature of -16 degrees.
604
605
« PRIVATE OPINION »
Maybe a wintercoat-wearing yet active soldier is more useful than a frozen soldier. This way Rain could replace his soldier mate in the radio show on three occasions, as at the time KCM have caught a cold so bad that not a single sound could leave his throat for weeks.
606
« SUMMARY »
So, according to the Dispatch, Rain was ON REGULAR LEAVE all three times, not on official, task assignment furlough.
607
Therefore each published fact by the Dispatch is considered THE INFRINGEMENT OF PRIVACY.
But let's see how these facts of the newspaper reinforce our claims.
608
THE EVENTS DURING THE LEAVES ACCORDING TO THE DISPATCH
609
« THE FACTS »
What did the Dispatch see exactly on the concerned three days?
610
11/23
"They both arrived driving their own cars to the meeting. ... After the date they left driving their own cars again."
611
612
11/23
"First time they tried to organize a short meeting on 11/23 in a third location. The meeting place was at the Han Park in Geumho-dong. Kim Tae-hee with his own Toyota Camry, Rain with his family BMW Mini Cooper came. Kim Tae-hee changed Rain's car and they held a brief pleasant car date."
613
614
« SUMMARY »
So, on 11/23 Rain and Kim Tae-hee met next to a park, arriving separately in their own cars. Kim Tae-hee took a seat in Rain's car but after a brief moment they left separately in their own cars.
615
« 11/23/2012 »
616
« CLARIFICATION »
Do we know anything about the closer time of the meeting on 11/23?
617
Based on the lights of the photo and on the fact that Rain had to take his car home after, the meeting probably took place in the early evening of a dark winter day. Presumably he headed home first and then returned to the barracks.
618
« CLARIFYING »
On 11/23, did Kim Tae-hee take Rain back with her own car to the military base?
619
We do not know. But as they left the meeting separately, there is a minimum chance that she did so. Rain probably returned by taxi to the military base like the other days.
620

They stopped at a little shop and Kim Tae-hee bought alone a few things for Rain. After a while Rain got out of the car. He took the packet with him what he received from Kim Tae-hee after he got out of the driver's seat. Then he went by taxi back to the unit."

He had to return on the same day so he was in the military attire during the date. They parted around 11 in the evening, Rain caught a taxi and went back to the unit."

« SUMMARY »
12/01-02 and 08-09
ON SATURDAY evening, when Rain finished his work in the radio studio and his vacation started, Kim Tae-hee went for him by her car to the radio studio and picked him up.
ON SUNDAY, Rain driving Kim Tae-hee's car took his lover back to her house. They said goodbye in the car and then Rain went back from there by taxi to the barracks. On 12/02 they stopped at a convenience store where Kim Tae-hee bought alone a few things for Rain.

650
« CLARIFICATION »
Do we know that where did they depart on those two Sundays from, when Rain took Kim Tae-hee home?
651
We can only infer it. The Dispatch mentioned the couple's flats as their "hideouts" and named the park as a "third venue". Therefore, in all probability, the two met at Rain's house on those two Sundays and Rain took home Kim Tae-hee from there.
652
« CLARIFYING »
So, according to the Dispatch, did Kim Tae-hee take Rain back to the unit by her car?
653
NO, Rain went back by taxi there.
654
« CLARIFYING »
Did the regulations of the unit prohibit the transport by taxi?
655
NO, SINCE THEY EVEN ENCOURAGED THIS.
656
« CLARIFYING »
Is there such military specification which would prohibit the soldiers meeting with their family members, loved ones or anyone else during their regular vacation?
657
NO, there isn't.
658
« CLARIFYING »
May the soldier take a parent, a friend, a spouse, a lover or even an acquintance back to the barracks at the end of his regular leave?
659
YES, they may.
660
« CLARIFYING »
When Rain was on a regular leave, then did the previous statements apply at him too?
661
YES, they did.
After all, Rain had to be treated in the same way as any other ordinary soldier.
662
« CLARIFYING »
Is there any reference in the articles of the Dispatch to Rain's daytime task in the studio or any other official activity?
663
NO, there isn't.
664
IN CONCLUSION:
Based on the reports of the Dispatch Rain has not committed any violations.
SINCE HE WAS NOT ON OFFICIAL, TASK ASSIGNMENT FURLOUGH,
so he neither neglected his tasks nor contacted with a civil person illegally.
665
What was the first part of our third claim?
666
A.
Rain, or rather private soldier Ji-hoon Jung did not violate the military rules.
B.
The mild punishment which was decided in his disciplinary case was an unfortunate example of when legality is not the same as justice.
667
Can we state that the facts justify this part of our third claim?
668
YES, we can.
669
« IT IS WORTH CONSIDERING »
Since his first vacation, Rain was aware that the tabloid spied on him during his military service too. Knowing this, completely unthinkable that Rain, who was famous about his legendary discipline as a civilian, would have made irresponsible actions which would have jeoperdized his own career or his lover's reputation.
670
"While I was on leave a couple of days ago, paparazzi infriged on my privacy. I didn't know there were paparazzi in front a cafe where I was drinking some coffee with my friends. That was my first recreation for a long time.
Let me take this opportunity to say a word. I ask them to respect my privacy."
RAIN, The Desire To Speed, 05/12/2012
671
11TH CHAPTER
THE PROOF OF OUR FOURTH CLAIM
672
673
THE ROLE OF THE TABLOID
674
« DIRTY TABLOID TRICKS »
However the Dispatch dragged Rain's name through the mire two different ways:
1. While seemingly they 'deified' him, in fact it was described as if he was only interested in vacations to rendezvous.
2. Repeatedly reiterated that his PR-soldier status allowed a lot of leaves. They put the words into anonymous informants' mouth that the celebrity-soldiers receives a lot of additional leaves and Rain's vacations exceed his peers' vacations as well.
675
« WELL-THOUGHT-OUT ACTION PLAN »
What was the Dispatch's strategy to excite the hype?
676
The Dispatch linked
the political accusations which were put forward by the Democratic United Party (DUP) against the DEMA
and
the tabloid sensation, which was built around the unveiling of Rain's private life by the tabloid.
677
Already both of these factors by themselves were able to trigger very strong emotions but by their cumulations
THE HYPE BROKE LOOSE.
678
The articles of the Dispatch are seemingly about a new relationship. Their real aim is to cause a scandal around the PR-soldiers.
679
« IS IT A COINCIDENCE? »
We know that the Dispatch watched Rain at all times during his military service.
The beginning of the daily followings shows an interesting correlation with the date of end of October, when the DUP failed their political attack, in which their cross-hairs was in Rain's direction.
680
« PURPOSEFUL »
What was the tactics of the Dispatch?
681
« TIMING »
The Dispatch timed the publishing of the articles on the morning of the first day of the year, which is a public holiday.
682
« CONSIDERED DECISION »
What could be the explanation of this?
683
« TO GAIN TIME »
On the public holiday the people had more time to deal with the tabloid news and the official operation probably was in greatly reduced mode at the Ministry of Defense as well.
Thus the Dispatch took a one day advantage ahead of the officials.
684
« ZERO JOURNALISTIC ETHICS »
The Dispatch did not take chances: on the morning of the 1st of January at 7:05 am published on its own website
7 articles (!!!)
on the subject with different titles and length in which they varied the same texts only with small changes.
685-687
688
Why didn't the Dispatch publish all the details in a single article?

On the one hand:
Because this way they could sensationalize the little amount of fact they had and make the concrete information incomprehensible to the readers.
So they made a lot of photomontage from their few photos and they hide the few facts amongst a lot of gimmicky filling-texts.
690
On the other hand:
Because each newspaper, television program, community site republished all the articles again and again, adding new lines and new information to them, the coverage of the topic multiplied in the media.
The public could get the impression that everyone, everywhere talking about the incident.

« TECHNICAL MANIPULATIONS »
What tricks did the Dispatch use to generate the hype?
700
The dates of the last modifications of the articles can be seen on the Nate's site:
15:49 (4 article) / 15:57 / 15:58 / 23:18
However, substantial content changes were not made, only small, mostly word order changes.
701
The purpose of these daytime mock-modifications was a technical tool so the articles could remanin at the top of the news feed as well as would come up as first hits on the search engines.
This has led to the internet users constantly caming across to the Dispatch's articles and their further sharing and publishing throughout the day.
702
Within moments the abbreviated or reworded re-published articles that lacked or distorted some important information of the originals such as the exact dates or the examined period flooded the written, the electronic and the social media.
Therefore the netizens interpreted that Rain was on date during every official leaves or actually he constantly dated during his whole mandatory military service.
703
As a result on of the most astonishing hype in the history of media has developed at a tremendous rate, which had three main lines:
- digging in the private life,
- accusation regarding excessive allowances,
- assumption of the personal misconduct
all got tangled up hopelessly.
704
« HYPE SURROUNDING THE COUPLE'S PARTNERSHIP »
705
The relationship of Rain and Kim Tae-hee, who is reckoned as astonishingly beautiful, smart and virtuous, intrigued the people's fantazy in several aspects. Beyond the many supporting manifestations the sense of envy was also released towards Rain's new success:
in addition to his amazing results how could he win her heart, especially as a soldier?
706
The media flooded the new about...
the official confirmation of their relationship...
Rain's courtship methods...
Kim Tae-hee's utterances...
how they got to know each other...
their random meetings over the years...
speculations about their relationship's future in which even fortune tellers got involved...
not to mention the computer modeling of their unborn child's appearance...
707
« RAIN! RAIN! RAIN! »
Of course the key-word of the reports is RAIN's name who remains silent the whole time, because as a soldier he cannot make any statement in private matters.
708
The netizens questioned Rain's right to a relationship with such force that at least a pastor spoke up in his protection.
709
THE ROLE OF THE NETIZENS
710
« HYPE AGAINST THE PR-SOLDIERS »
711
« PREJUDICE »
On the community surfaces was formed a regular campaign against the celebrities who served their compulsory military time in the army. It has become a tangible prejudice that the work of the performers and actors has no actual value. Therefore it is not equivalent to the other soldiers' "sacrifices", and ensuring the conditions that are necessary for the fulfillment to their tasks is identical to the "special treatment".
712
« IMAGE OF A COMMON ENEMY »
The netizens have found an image for a common enemy in the celebrity soldiers, who were embodied by Rain for them in the current news. Rain was contrasted with their first or second hand experiences in the life in the military. In contrast to the "no-good celebrity" the figure of the "ordinary soldier" became noble, as if the conscripts were all perfect without exception.
713
« COMPETITION OF THE PATRIOTS »
On the community surfaces everyone felt to be a greater patriot than Rain who was in fact serving as a soldier. Even those men who confessed that they will only join the army sometime in the future. The women didn't remain silent either. The media kept delivering the indignant, mood-enhancer people who hide themselves behind anonymity, distorted sounds or pictures and theatrically sobbed their own or their sons', husbands', lovers' sorrow crying favouritism.
714
« SIDE EFFECT »
Everyone just talked and talked about their own bad experiences.
They did not realize that they presented the army as such a rigorous organization that is inhuman, doesn't allow any vacations, ignores the illnesses of the soldiers, doesn't allow a leave for a family member's funeral either, etc.
715
« WORSE IS BETTER! »
Food for thought: The demand to change those bad practices or the feeling of necessity to take actions against them never actually occured.
It is strange that the netizens ultimately insisted on the "cruel" image of the army.
715
« TENDENCY TO TAKE THE LAW INTO THEIR OWN HANDS »
The most bloodthirsty netizens shared wilder and wilder ideas to punish Rain - from imprisonment through the extension of his mandatory military service as far as to his transfer to the front.
They did not concern themselves with the fact that they had no way of knowing if Rain have committed any error.
717
« CONFUSED EMOTIONS »
Based on the past behaviour of Rain, people who became attached to him over the past decade found it difficult to believe that everything that was said about him would be true.
However, many people hesitated under the pressure of public opinion and they noted defensively that if any of the charges proven to be true then they will also turn away from him.
718
« THEIR THOUGHTS WERE SERIOUS »
What was the strangest suggestion of the netizens?
719
Many netizens call Rain to account that why did not he 'exercise moderation' in taking advantage of the 'preferences'?
What 'preferences' did the questions refer to? Of course to the military performances in the countryside and to the two military concerts at the Yeosu Expo.
Well, did Rain decide about these himself? Did not he receive his tasks as a command?
720
So the netizens expected a soldier to deliberate and dispute an order he received.
They did not think of the consequences that follows a non-compliance with orders in the army.
Although they were unable to think through such basic ideas they were confident about Rain and the other PR-soldiers being guilty.
721
« RAIN! RAIN! RAIN! »
In the controversies of the social network sites which were about the overall situation of the PR-soldiers, RAIN's name became the key word, since the media always referred to his current things as an example. Rain had no chance to defend himself, because as a soldier he could not speak up at all.
722
The netizens attacked Rain with such force and with such nonsenses that in order to protect him it hand to refer his fundamental human rights.
723
THE ABERRATION OF THE MEDIA
724
« BATTLE OF NUMBERS »
725
In the media there was an oddish battle about the numbers of the vacation days which were given to the celebrity soldieers, especially Rain.
Every media outlet has sought to serve his own audience with the biggest scandal, so and in order to do so they raised the previous numbers.
726
In a single day, on 01/02/2012 the following numbers roamed about the coverages about Rain's vacation days:
727
60 days - 01.02. Mydaily/allkpop
62 days - 01.02. Soompi
62 days - only until October - in according to the datas of the Democratic United Party
01.02. enewsworld
71 days - 01.02. allkpop
75 days - 01.02. Sung-joon Jin lawyer, Democratic United Party (DUP)
94 days - 01.02. KBS YunYeGaJunGye
728
« THE CLUES TRAILS TO THE »
Where were these numbers coming from?
729
« MIXING THE SHEEP AND THE GOATS »
Following the procedure of the Democratic United Party (DUP) they added up the numbers of the regular vacation days, the official furloughs, the permission of the overnights and sick-leaves in different versions, striving to produce the strongest shocking datas.
730
731
Everyone focused on the vacations of the DEMA period. We already know that the numbers of Rain's total vacation days during this period were: 23 days.
732
733
Against the earlier statement of the Ministry of Defense on KBS TV on 01/05 the highest 94-day total vacation was still compared to the average 43-day vacation which was given to the soldiers.
734
735
« REMINDER: THE REALITY »
736
This practice is endlessly repeated in the media to this day.
737
So were the calculations false which were published in the media?
738
YES, they were.
739
What makes this whole distortion-based campaign more terrifying is that the media is endlessly repeating their confusing numbers, despite
the Ministry of Defense already unveilded the real facts on 01/03/2013.
740
Then on 01/05 on the Channel A television Mr. In Gyun Shin, the representative of the Independent Network of National Defense gave a 25-minute, detailed introduction about the background of Rain's regular vacations and official leaves.
But it seemed that the reality was not as exciting as the artificially induced scandal.
741
« MR. IN GYUN SHIN, THE REPRESENTATIVE OF THE INDEPENDENT NETWORK OF NATIONAL DEFENSE »
742
Nothing was enough for the netizens and their imaginations were very vivid.
There was someone commenting about a more than 110-day vacation that Rain was allegedly taking - all attached to a Youtube video since they felt the need to make defamatory notes everywhere.

The number of the coverages seemed to be infinite which only increased the chaos. At times it was evident that the authors did not understand anything, if they did, allegations such as him taking an 11-day leave in 2011 would not have been made.
Frankly we are curious where could he loll during the basic training or the military preparedness?

« A QUESTION PRESENTS ITSELF »
But are these all not only the Koreans internal matters?
751
« THE CONSEQENCE OF THE CULTURAL EXPANSION »
Not nearly. The news of the Korean media spreads fast through the international news channels from which the follower of the Korean culture could get their informations. The false publications remained uncorrected for the international public too.
752
Rain is a star of the international music, film and fashion world. On multiple occasions he was a proud member of the TIME 100 'Most Influental People of the Year'. The false news gave him a bad reputation in the profession as well as in the circles of some audiences whose interest goes far beyond Korea.

It is perplexing, that the civilians, who just awakened after an elated night, holding their morning coffee and seeing the articles of the Dispatch could immediately place themselves into combat mode.

and to write petitions to the Ministry of Defense!

« VOLUNTARY INFORMER - 1 »
In addition to the submissions enquiring about the circumstances of the rendezvous, the Ministry of Defense also received a "citizen's complaint", what can definitely be called the moral nadir of this story, namely due to the informer's strange morality.

It is a fact, that to the first working day of the year the Ministry of Defense has faced with that the media was noisy due to the DEMA affairs and its website was filled with thousands of outraged entries.
775
During the first three days of the hype the media and the netizens has become so intense that there was limited room for the maneuver of the Ministry of Defense, which, while receiving attacks itself, had to proceed in Rain's case.
776
For this reason the utterances of the DEMA and the Ministry of Defense were fickle.
777
Obviously nobody could know Rain's schedule more precisely than DEMA. Therefore the representative of the DEMA firmly declared on the 2nd of January:

"The controversy raised by the claim that some PD soldiers had received preferential treatment, in therms of vacation hours, was completely clarified during an inspection of state administration. The controversy about whether Rain has received preferential treatment, can be understood in the same context. At present, Rain's vacation hours or sleeping out is not an offence."

785
On 01/04 everything has changed. By this time articles were published that raised questions about the responsibility of the management of the DEMA and the Ministry of Defense.
786
The Ministry of Defense had to do something in order to calm the unleashed passions down, so they announced that
- a disciplinary investigation will be launched against Rain,
- the regulations of the DEMA will be tightened.
787
However, the Ministry sent messages not only the the uproared mass but also to those who recognized the absurdity of the whole hype:
the officials communicated constantly that rest assured, Rain's punishment won't be severe.
788
What was the reason for the Ministry of Defense to order a disciplinary action?
789
The only tangible clue supporting the disciplinary action was the regulation regarding the wearing of the uniform by which they could determine an actual violation. So the first accusation stated that the beret was not worn which was confirmed by the photos of the Dispatch.
790
« VARIATIONS ON A THEME »
According to the article of the Soompi the spokesperson of the Ministry of Defense spoke in conditional tense:
791-792
793
While 'The Chosun Ilbo' stated that what the spokesperson said were facts.
That is strange as the disciplinary hearing has not even started at this point, so it seemed premature to treat the violations as facts instead of the charges. Particularly in those misdemeanors that Rain had already conceded - so why was a hearing even necessary?

"Regarding the criticism that Rain had private meetings while on leave for official work duties:
It is possible that a soldier may go to a convenience store, for example, or take care of a little bit of personal business at such times. Also, if a soldier's home is in Seoul, it's also conventionally considered possible that he might briefly meet with a friend. I think it's excessively harsh to impose such regulations with absolute strictness (ony in the case of Rain)."
800
The Center on Military Human Rights placed the case of Rain and the regulations of the military leaves on his agenda of the regular meeting and they been following closely the process of the disciplinary action.
801
As the disciplinary hearing set off with four charges:
1. Rain was not wearing his beret together with his uniform in accordance with the regulations,
2-3-4. on three occasions he contacted a civil person during his official furlough.
802
BUT WHAT ARE THESE CHARGES?
???
803
The statements of the spokesperson of the Ministry of Defense do not meet at all the documents which were published in the Dispatch's photo report -
however without them Rain would not fall under suspicion.
804
805
Let's give it a try: let's assume that, according to the statement of the Ministry of Defense, Rain had to work on those days.
In this case, those photos did not match the spokesperson's statement which was confirming that Rain did not travel back to the base in Kim Tae-hee's car, but rather he went back by taxi.
806
« 12/02 »
807
« 12/09 »
808
But if the photos are conclusive evidences for not wearing his beret, then should they be accepted as evidences on this issue too.
809
« NOT EASY BUT WE TRY »
Is it possible to find an explanation for this?
810
At a first read it seemed that not only the Ministry of Defense but seemingly everyone got the dates published in the Dispatch's articles confused.
We also noted in our analysis in 2013 that it seems "according to Dispatch all Sundays were on Saturdays in December".
811
It was widely known that the programs of 'The Desire To Speed' were on broadcast on Saturdays and Sundays. Therefore, everyone thought that Rain was in the studio on both days.
It escaped everybody's attention seemingly including the Ministry of Defense as well that some broadcasts were pre-recorded.
812
The earlier mentioned, cunningly formulated sentence of the Dispatch
"They met using up time for leave."
mixed with the previous information including the evening lights on the photos and the specific mention of that Kim Tae-hee picking up Rain at the studio and then later saying goodbye to him in the car.
813
Since they marked only Sundays with exact dates it escaped the attention that the articles contains mosaic pieces from both days of the weekends: Saturdays as well Sundays.
814
The spokesperson of the Ministry of Defense partially outlined this incomplete mosaic to the public, which also regrettable but since it happened before the disciplinary investigation, maybe understandable due to the nervousness of the hectic situation.
815
On the other hand it seems as if the accusations were made for the netizens, simply repeating the insinuations they contrived. Given the situation it is not surprising since the Ministry of Defense tried to take the wind out of the sails of the furious crowd.
816
But if so, it is highlights an unfortunate thing:
the accusations were made at a desk and that time nobody asked Rain about what really happened.
817
« ORIENTING SIGNIFICANCE OF THIS FACT »
Why is the official wording of the charges such an important moment of this story?
818
It must be emphasized that not a single forum voiced the idea, not even as a possibility, that the meetings might have been during regular leaves and therefore Rain might be innocent.
Everyone treated unamimously as a proven fact that he violated the military rules during his official leave.
819
Over the stormy and chaotic three days of hype the Ministry of Defense was the only official source and the words of the spokesperson were the authoritative guidelines for the public to which facts were false or true - including the impartial observers and those who were worried about Rain.
AND THE ACCUSATION REINFORCED THE FALSE PRECONCEPTION.
820
What is the most regrettable:
Obviously, that the DEMA and the Ministry of Defense were been fully aware from the first moment that Rain did not commit any misdemeanor.
Not even the absence of the wearing of beret, since a preferential verdict is an incorrect procedure against one person in case of a widespread bad practice.
So it was inreasonable to launch a disciplinary action against Rain.
821
However it seems that the Ministry of Defense decided to sacrifice Rain's reputation, against the DEMA's initial strong resolution.
On the long run it did not relieve anything that the disciplinary committee only imposed a pretense penalty.
822
The disciplinary hearing began on 8st of January and during the procedure the violation committed by dating simply became weightless, probably dur to truth that has been said during the course of the hearing.
823
Not wearing the beret was the more severe or in fact the only proven offense.
However, an other curiosity happened which strengthened the suspicion again that counterforces were working in the background.
824
« VOLUNTARY INFORMER - 2 »
It is possible that those lonely netizens who nosed after the PR-soldiers also could fing the information about Rain staying at a hotel in Jeju after an earlier military performance. But in this case they had to see immediately that all 49 members of the unit, including the officials did the same, since the sponsors of the Jeju event were those four leading hotels which provided the accomodations for the performers.
825
But it is not really typical of a hot-tempered, lonely citizen
- to withhold the information for a long time (the event was half year ago on 06/01)
or
- to time the publication of the denouncement in the press exactly on the days of the disciplinary action in which they primarily accused Rain.
826
In this moment perhaps the biggest problem of the whole hype is clearly visible: all along during the public debate the levels of responsibility of the commanders and the conscripts were completely mixed up.
Therefore it is amazing that such question that clearly falls under the responsibility of the military leaders' was clarified as part of the disciplinary hearing of Rain, an ordinary soldier.
827
« THE MONTAINS HAVE BROUGHT FORTH A MOUSE »
What was the outcome of the disciplinary hearing?
828
The punishment by the disciplinary committee was the mildest which could be given:
During a 'probation week' Rain could not leave the military base, he had to read two books and had to write a self-reflecting letter.
829
The Ministry of Defense informed the public about the penalty in a short statement, in which, far as we know
they did not mention on which charges the disciplinary committee found Rain innocent or guilty.
and with this the Ministry has regarded the issue as closed.
830
« KEY QUESTION »
How did it spread as a fact that Rain committed violations during his official leaves?
831
Such that, in addition to the short statement of the Ministry of Defense about the decision of the disciplinary committee
THE REPORTERS CITED AND REPEATED THE SPOKESPERSON'S PRE-TRIAL STATEMENTS
from when he presented the charges that went before the committee.
832
We illustrate this procedure with an example of the prestigious daily newspaper, The Chosun Ilbo again, which was practiced by every greater or lesser media outlet or community sites.
AT TWO DIFFERENT TIMES DATED (SO PRE-TRIAL AND POST-TRIAL) ARTICLE'S HIGHLIGHTED LINES ARE IDENTICAL IN THEIR WORDING.

835
Top of all in the article on the penalty they repeat the biggest lie of the whole hype about the false numbers of the vacation days, if it would be true, the superiors would have responsibility for it and not Rain.
836
In addition to the penalty thus repeated charges burned into the public consciousness the false fact of Rain's military violation.
837
http://www.english.chosun.com/site/data/html_dir/2013/01/09/2013010900813.html

Well, we have solved the mystery of the lack of beret!
850
Thanks to the Dispatch we know that on the evening of 12/02 Rain got out of Kim Tae-hee's car and got into the arriving taxi. During the change he was not wearing his beret.
BUT WHERE WAS HIS BERET?
851
852
So Rain was able to cause a permanent damage of the nation's dignity by taking a few meters between two cars without a beret at night in a deserted park.
Sorry for the joke, but...
This case demonstrates brilliantly that Rain became one of the TIME 100 'Most Influential People' not without any reason.

We leave it to you to judge how vile was it to accuse Rain with such trivial matters,
who in fact, looked every minutes of his mandatory military service as if he would had been an exemplary illustration of the military rolebook
and who seemed more dignified than anyone in the army setting an example that will be hard to follow for the future conscripts.
864
865
But it is certain, that no one took interest in wearing a beeret before or ever since.
In nowadays press photos keep appearing daily showing famous and non-famous soldiers, officerts and privates alike not wearing their berets and seemingly no one misses them.

What was our entire third claim?
870
A.
Rain, or rather private soldier Ji-hoon Jung did not violate the military rules.
B.
The mild punishment which was decided in his disciplinary case was an unfortunate example of when legality is not the same as justice.
871
Can we state that the facts justify our third claim?
872
YES, we can.
873

RETURN TO THE WEEKDAYS
875
What has happened in the remaining half year period of Rain's mandatory military service?
876
Following the disciplinary hearing Rain's fellow soldiers gave many signs of their solidarity. Among the soldiers was evident that the accusations dragged Rain's name innocently through the mire.
Shortly after the incident the members of the PR-unit elected Rain unit commander without hesitation.

The superiors' confidence also was unbroken in Rain. An obvious example of it that Rain took part as a PR-soldier of the governmental cultural delegation at the Arirang Festival in the US, which was a remembrance event series of the 60th anniversary of the Korean War.
880
881
Since Rain fulfilled his mandatory military service with commitment and excellently, in recognition of this
his was discharged from the army in honour, ceremoniously
in 07/10/2013.

Rain has became the last solemny discharged soldier of the PR-unit. He was not part of the turmoil which led to the unit's disband - no matter how much the media and enemies wanted him to be.

What has happened in the media and on social networking sites after the disciplinary hearing in January?
890
An incomprehensible, strange revenge was launched and with a campagne of hate, offering a variety that reverberates to this day.
891
"I would just serve on the front right now if I could, but shifting my position won't solve the problem." - wrote Rain in his letter.
The interpretation of the media:
RAIN REQUESTED HIS TRANSFER TO THE FRONTLINE!
892
They liked their own idea so much that they started to enforce it -
the Ministry of Defense had to issue a notice to stop them.
893
The newer article of The Chosun Ilbo is like the "veterinarians' horse"
which means that it includes all the distorted elements of the hype. In addition to the mew facts those lies which were officially refuted several times are also being repeated as mantras.

Rain, however, generously helped the media worker who tripped just before him...
902
If the host would like to thank you and you reject the offer - it is a great insult. Therefore, the superiors encouraged the PR-soldiers to accept the beverages of the hosts after an official performance. Then the drunk soldiers did something which would not have come to their mind if they had been sober. There are violations in every field.
But could a soldier mate who was not even ther in their company be held responsible for all this?
903
Since this incident occured almost immediately before Rain's discharge, it was clarified firstly whether he participated in the incident.
It turned out that he joined another company on that evening for a short time and went to bed early.
904
It did not bother the media at all, they mentioned Rain's name in the titles and the contents of their reports. For example the false coverage the Yonhap News was published throughout the world.
Many of Rain's fans asked corrections and the hones media outlets complied with the request. Among them were The Korea Herald and The Global Post.

They welcomed Rain's return to the civilian life in this way:

912
« POLITICAL VULTURES »
The Democratic United Party fueled the passions brazenly to the last option against Rain and the Ministry of Defense. Their lawyers "examined" again around the DEMA's elimination -
and now they picked on the paperwork.
913
They stated that Rain (later turned out that 10 PR-soldiers in total) came to the unit without the submission of the necessary documentation (other version: incomplete documentation) to apply.
914
In a plothole they merged this case with the previous "high-profile" incident that was a work of fiction created by them. (!!!)
They were ready with their own verdict and one of their assemblyman called Rain for its implementation:
ask for the re-enlistment and repeat his entire mandatory military service.
915-918
919
What did we emphasize at the beginning of this film in connection with Rain's application to the DEMA?
920
In according to the DEMA's statement RAIN SUBMITTED the required documents for his application on 02/16/2012.
921
Against the strong and indeed legitimate statement of the Ministry of Defense the Democratic United Party retreated.
922
923
Or did they just seemingly back down?
Whether the DUP was directly involved or only by the excitation of anger in the next case it is all the same.
At the end of the year there was still energey for an atrocious step.
924
« VOLUNTARY INFORMER - 3 »
A citizen, again hiding behind anonymity, walked into a police station (!) and reported Rain with that accusation that he received too much vacation during his military service.
925-927
928
« NEWS ON THE REJECTION OF THE COMPLAINT »
929
The case became a media news again but not a word was said about that the idea is a legal nonsense in multiple way:
- the same offense cannot be punished twice
and
- in military affairs either the police (where the accusation was submitted) nor the civil court (which refused the accusation) are not cometent.
930
Instead, though it was the end of the year, they repeated again the CHARGES of the January incident.
931
What was our fourth claim?
932
Rain's hard won reputation and social status have been abused by the selfish interest of the politics and the media, deceiving the citizens who trusted the authenticity of their information.
933
Can we state that the facts justify our fourth claim?
934
YES, we can.
935
« A LIGHT-BULB MOMENT »
936
Thus, the strange situation that currently exists has comeup and it only shows a substantial change very slowly. There are no news regarding Rain to which such netizens would not comment, who
heard something...
remember something...
937
What exactly? They don't know. They are only sure that Rain should not to be appreciated and loved for some reason. They should despise him as everyone is doing it so.
Rain certainly is not trendy...
938
Rain has no fans...
Rain is not talented...
Rain is not a world star...
Rain is superannuated...
Rain... Rain... Rain... Rain...
Because as soon as Rain makes a move, everyone is already talking about him.
But why?
Because after all he is RAIN.
939
Of course everyone knows somewhere deep in him- or herself that Rain is unavoidable.
Not only due to his extraordinary past but also due to his hopeful future which is in front of him.
940
It cannot be changed that with his countless extraordinary performances
Rain already has been indelibly entered into the "golden book" of the cultural achievements of Korea.
941
Rain is working right now with amazing energy. The interest in his last TV series already indicates
10 billion clicks on the web. The people who move the fingers have no doubt about the excellence of Rain.
It is true that they are mostly not Koreans so the infightings of Rain's country are less affected their judgements of value.
942
We believe that the majority of Rain's compatriots have a different feeling in their hearts from what the faceless, inhuman netizens wish to force upon them.
We hope that this film can help and encourage them to express their real feelings no matter how blandly they wish to do it.
943
Especially for those who have been entagled into this very confusing case which was artificially aroused around Rain, we repeat our final summary what we made at the beginning of this film.
944
RAIN WAS COMPLETELY INNOCENT OF ALL CHARGES AGAINST HIM.
What could be the moral of this story?
946
Perhaps the fact it is possible that not wearing a beret could leave a stain on a nation's honor.
But assuredly not so great as if we don't trust in our best forces.
947
« IS THERE A SOLUTION? »
How can the absurdity of this situation be solved?
948
It does not take much effort...
949
... just a little objectivity,
that lets us re-evaluate the events, and it's never too late for doing so.
... just a little courage,
to make a stand for the trustworthiness and honesty, which is sometimes necessary against the self-assertive unprincipledness.
... just a little love and appreciation,
to support them who are worthy and that we can do that, perhaps it is our fines human ability.
